Background to Review

In 2006 the NSW State Government introduced significant changes to the structure and content of Local Environmental Plans (LEPs). The NSW Government’s aim is to provide greater consistency in LEPs across the State, and a streamlined and simplified planning system.
One of the changes was the introduction of the ‘Standard Instrument’ which Council’s have to use while preparing new LEPs. Under the Standard LEP approach, all LEPs across NSW will have a consistent format, utilise the same zones, share a number of mandatory provisions and have common definitions.

Council has now prepared the draft Eurobodalla Local Environmental Plan 2009 (LEP) 2009 to replace the existing Eurobodalla Urban Local Environmental Plan 1999 and the Eurobodalla Rural Local Environmental Plan 1987. The LEP will apply to the whole of the Eurobodalla local government area. The new LEP is consistent with the standard LEP instrument (template) introduced by the State Government in March 2006.
The preparation of the new LEP has been a long and involved process, and Council has been working with the Department of Planning, continuing developing and altering the document in line with State Government requirements.
The new LEP will:
- implement the Eurobodalla Settlement Strategy and Structure Plans as endorsed by the DoP
- Carry out a transfer of relevant provisions from the Eurobodalla Local Environmental Plans into the standard template format
- rezone all of the land in the Shire consistent with the standard template zones
- set out new permitted and prohibited uses in zones consistent with DoP guidelines
- establish new planning requirements and considerations where necessary
As well as the new LEP, Council is also developing new development control plans (DCPs) which will cover the whole Shire, in line with the NSW government requirements, one DCP per property. These DCPs will replace all of Council’s current DCPs and will be exhibited progressively over the next twelve months or so as they are completed.
It is anticipated that the first four DCPs will be on exhibition by mid 2009. These DCPs will cover the following areas:
- Batemans Bay Regional Centre
- Moruya Township
- Narooma Township
- Residential Zones
