Development approval, compliance, and enforcement

Most building, demolition, and development work in Eurobodalla requires planning approval through a development application (DA). Some minor or low-impact work may not need a DA.

Exempt and complying development

Some types of development are either exempt from approval or can be approved through a complying development certificate (CDC), provided they meet certain development standards.

Complying development+

These types of development may qualify for fast-tracked approval (complying development certificate) if they meet the standards under the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008:

You can also contact a registered certifier to find out if your development meets the standards for complying development. If it doesn't, you'll need to submit a DA.

When you need a DA

If your project doesn't meet the requirements for exempt or complying development, you'll need to submit a DA to Council for formal assessment and approval.

Before you start building: Get a construction certificate

After you get development approval (consent), you must engage a registered certifier to issue a construction certificate (CC). You will need a CC before you start any building work.

What certifiers do+

  • Carry out mandatory inspections during construction.
  • Check compliance with relevant approvals.
  • Issue an occupation certificate when the work is finished.

Concerns or complaints about a certifier+

If you have concerns about a certifier's actions:

  • First, contact the certifier to resolve the issue.
  • If you are not able to resolve the issue with the certifier, contact Building Commission NSW.

Unauthorised or Illegal building work

It is against the law to carry out building work that:

  1. starts without the required approvals (DA, CDC, or CC)
  2. doesn't follow the approved plans or conditions of consent.

How Council enforces compliance+

Council follows a process to investigate and address breaches of planning and building regulations. You can read this process in our Compliance Policy:

Actions may include:

  • issuing notices or fines
  • taking legal action to ensure compliance.

These actions help to protect residents from unsafe or poor-quality construction.

How to report non-compliant work+

If you notice building work that may be unauthorised or non-compliant:

  1. Contact the certifier listed on the sign at the front of the development site.
  2. If you're unable to resolve the issue, contact Council:
