Voluntary planning agreement register
A voluntary planning agreement (VPA) is a legal agreement between a planning authority (like Council) and a developer. A VPA is negotiated when a developer seeks approval for a development, either to change an environmental planning instrument (EPI) or for development consent. In exchange for development approval, the developer agrees to provide specific community benefits such as:
- public infrastructure
- transport infrastructure
- affordable housing
- open space and environmental improvements.
Key requirements for a VPA
A VPA must:
- align with relevant planning rules (eg, local environmental plans and development control plans)
- serve the public interest
- include reasonable benefits or contributions from the developer.
Under the Environmental Planning and Assessment Regulation 2021, Council maintains a public register of all VPAs. The register includes:
- a description of the development
- the land affected by the agreement
- the names of the parties involved
- the date the agreement was made.
